Terms of Service
Plain-English Summary
These Terms govern your use of the Freedive Finder app. Key points:
- You must be at least 18 years old to use the App
- You are responsible for your account security and the accuracy of your profile
- Content you create (messages, photos, site descriptions) remains yours, but you grant us a licence to display it in the App
- Freediving is inherently dangerous — the App is a coordination tool, not safety equipment or professional advice
- We can suspend accounts that violate these Terms
- If you sign up for our beta waitlist, we may email you with updates about the beta program (see Section 4.3)
- Authorised platform administrators may access and moderate content in the normal operation of the service (see Section 4.4 and Privacy Policy §6.2)
- Australian Consumer Law guarantees apply — nothing in these Terms excludes or limits guarantees that cannot be excluded by law
1. Agreement to Terms
1.1 These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and Freedive Finder ("we", "us", "our") governing your access to and use of the Freedive Finder mobile application ("the App") and related services.
1.2 By creating an account or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1.3 If you do not agree to these Terms, you must not use the App.
2. Eligibility
2.1 You must be at least 18 years of age to create an account and use the App.
2.2 By creating an account, you represent and warrant that:
- (a) You are at least 18 years old
- (b) You have the legal capacity to enter into these Terms
- (c) Any information you provide is accurate and not misleading
2.3 Freediving is a physically demanding activity with inherent risks. You are solely responsible for assessing your own fitness, qualifications, and readiness to participate in any dive activity arranged through the App.
3. Account Registration and Security
3.1 To access the App's features, you must create an account using one of the following methods:
- (a) Email address and password
- (b) Google Sign-In
- (c) Apple Sign-In
3.2 You are responsible for:
- (a) Maintaining the confidentiality of your account credentials
- (b) All activity that occurs under your account
- (c) Notifying us immediately at christopher@freedivefinder.com if you become aware of any unauthorised use of your account
3.3 You must not:
- (a) Create more than one account per person
- (b) Share your account credentials with any other person
- (c) Use another person's account without their explicit permission
- (d) Impersonate any person or entity
4. Your Use of the App
4.1 Permitted Use
You may use the App (and the associated web surfaces) to:
- (a) Create and manage your diver profile
- (b) Discover and join freediving sessions organised by other users
- (c) Create and organise your own freediving sessions
- (d) Communicate with other divers through in-app group chat
- (e) Discover and contribute information about dive sites
- (f) Connect with dive buddies
- (g) Sign up for our beta waitlist at our website in order to be notified when beta access becomes available (see Section 4.3)
4.2 Prohibited Conduct
Freedive Finder has zero tolerance for objectionable content and abusive users. Violations may result in immediate content removal and account suspension, with or without prior warning.
You must not:
- (a) Use the App for any unlawful purpose or in violation of any applicable law
- (b) Post or transmit content that is defamatory, obscene, threatening, abusive, or discriminatory
- (c) Harass, bully, stalk, or intimidate other users
- (d) Transmit spam, unsolicited advertising, or commercial content to other users
- (e) Attempt to gain unauthorised access to other users' accounts, to the administrative interface, or to our systems
- (f) Reverse-engineer, decompile, or disassemble any part of the App (including the administrative interface)
- (g) Use automated systems (bots, scrapers) to access the App, the beta waitlist surface, or the administrative interface
- (h) Upload files containing viruses, malware, or other harmful code
- (i) Interfere with or disrupt the App's infrastructure or other users' access
- (j) Misrepresent your identity, qualifications, or experience level
- (k) Post inaccurate or misleading information about dive sites (e.g. incorrect depth, hazards, or access conditions) in a way that could endanger other divers
4.3 Beta Waitlist
If you sign up for our beta waitlist (see Privacy Policy §2.6 for the data collected), you agree:
- (a) That you may receive occasional email communications from us relating to the beta program (e.g. availability announcements, instructions, or required acknowledgements). Any such communication will identify us as the sender and will be sent in accordance with applicable law, including the Spam Act 2003 (Cth) where it applies.
- (b) That your waitlist record may be retained until you either convert to a full user account or the waitlist is retired; see Privacy Policy §10 for the current retention treatment.
- (c) That you must not submit false or deliberately misleading waitlist information, and must not use the waitlist surface to automate or enumerate signups.
- (d) That participation in the waitlist does not guarantee beta access; we may prioritise invites by region, platform readiness, or other operational criteria.
4.4 Administrative Access
The App is operated by authorised platform administrators who, in the course of running the service, may access user data via a dedicated administrative interface. See Privacy Policy §6.2 for the purposes and accountability measures that govern administrative access. By using the App, you acknowledge that such access is an ordinary part of the service's operation and not a disclosure to an unrelated third party. All administrative actions are recorded in an append-only audit log.
5. User-Generated Content
5.1 Your Content
"User Content" means any content you create, upload, or submit through the App, including but not limited to: profile information, chat messages, dive site descriptions, dive session details, photos, and reviews.
5.2 Ownership
You retain ownership of your User Content. However, by submitting User Content to the App, you grant us a non-exclusive, worldwide, royalty-free, transferable, sub-licensable licence to use, display, reproduce, modify (for formatting purposes), and distribute your User Content solely for the purpose of operating and providing the App's services.
5.3 Licence Duration
This licence continues for as long as your User Content remains on the App. When you delete your User Content or your account, we will remove it in accordance with our Privacy Policy, except:
- (a) Where copies have been made by other users through normal use (e.g. messages already read)
- (b) Where we are required by law to retain certain records
- (c) Where copies exist in routine backups (which are overwritten in the normal course of operations)
5.4 Content Standards
You represent and warrant that your User Content:
- (a) Is accurate to the best of your knowledge (particularly dive site information including depth, conditions, and hazards)
- (b) Does not infringe any third party's intellectual property, privacy, or other rights
- (c) Complies with the Prohibited Conduct rules in Section 4.2
- (d) Does not contain personal information of another individual without their consent
5.5 Content Moderation
We reserve the right (but are not obligated) to review, remove, or disable access to any User Content that we reasonably believe violates these Terms, poses a safety risk, or exposes the service to legal, compliance, or operational risk. Such review and removal may be performed by authorised platform administrators via the administrative interface described in Section 4.4 and Privacy Policy §6.2. We may act without prior notice.
Every administrative content action (review, remove, disable, restore) is recorded in our append-only administrative audit log for accountability.
6. Dive Safety Disclaimer
6.1 The App is a social coordination tool. It is NOT:
- (a) A substitute for professional freediving instruction, supervision, or certification
- (b) Safety equipment or a safety monitoring system
- (c) Medical or fitness advice
- (d) A guarantee that any dive site is safe, accessible, or suitable for any particular activity
6.2 You acknowledge and agree that:
- (a) Freediving is an inherently dangerous activity that carries risks of serious injury or death, including but not limited to shallow water blackout, hypoxia, barotrauma, drowning, and marine hazards
- (b) You participate in any dive activity arranged through the App entirely at your own risk
- (c) You are solely responsible for assessing your own physical fitness, training level, certification status, and readiness to dive
- (d) You should never freedive alone — the App facilitates buddy connections but does not guarantee buddy availability, reliability, or competence
- (e) Dive site information contributed by users may be inaccurate, incomplete, or outdated — you must independently verify conditions before diving
- (f) Weather, currents, visibility, and other environmental conditions can change rapidly and without warning
6.3 We are not responsible for:
- (a) The conduct, actions, or omissions of any user before, during, or after a dive
- (b) The accuracy of any dive site information, user profiles, certifications, or ratings displayed in the App
- (c) Any injury, loss, damage, or death arising from or related to any diving activity arranged, discovered, or discussed through the App
7. Intellectual Property
7.1 Our Intellectual Property
The App and its original content (excluding User Content), features, and functionality are owned by Freedive Finder and are protected by copyright, trademark, and other intellectual property laws of Australia and international treaties.
7.2 Restrictions
You must not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the App or its content without our prior written consent, except as expressly permitted by these Terms or by law.
7.3 Feedback
If you provide us with suggestions, ideas, or feedback about the App ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free licence to use that Feedback for any purpose without obligation to you.
8. Third-Party Services
8.1 The App integrates with the following third-party services:
- (a) Google Sign-In and Apple Sign-In for authentication
- (b) Google Maps and Apple Maps for map display and location features
- (c) Firebase Cloud Messaging for push notifications
- (d) Firebase Crashlytics for crash reporting
- (e) Amazon Web Services (AWS) for cloud hosting, database, and private image storage (images are served via short-lived secure links)
8.2 Your use of third-party services is subject to those providers' own terms and privacy policies. We are not liable for any third-party service's availability, accuracy, or conduct.
8.3 We are not responsible for the content or practices of any third-party website or service linked to or from the App.
9. Account Suspension and Termination
9.1 Termination by You
You may stop using the App and delete your account at any time via Settings → Account → Delete My Account. You can also contact us at christopher@freedivefinder.com if you cannot access the in-app flow.
9.2 Suspension or Termination by Us
We may suspend or terminate your account, without prior notice, if:
- (a) You breach any provision of these Terms
- (b) Your conduct poses a risk to the safety of other users
- (c) We are required to do so by law
- (d) We reasonably believe your account has been compromised
- (e) You have been inactive for more than 12 months
9.3 Effect of Termination
Upon termination:
- (a) Your right to access the App ceases immediately
- (b) We may delete your account data in accordance with our Privacy Policy
- (c) Sections that by their nature should survive termination will survive (including Sections 5.2, 6, 7, 10, 11, 12, and 14)
10. Limitation of Liability
10.1 Australian Consumer Law Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
10.2 Limitation Where Permitted
To the maximum extent permitted by law, and subject to Section 10.1:
- (a) The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied
- (b) We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses
- (c) Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App is limited to AUD $100 or the amount you have paid us in the 12 months preceding the claim, whichever is greater
- (d) We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill
10.3 Acknowledgement
You acknowledge that the App is provided free of charge and this is reflected in the allocation of risk in these Terms.
11. Indemnification
11.1 To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Freedive Finder from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- (a) Your use of the App
- (b) Your User Content
- (c) Your violation of these Terms
- (d) Your violation of any third party's rights
- (e) Any diving activity in which you participate that was arranged, discovered, or discussed through the App
12. Dispute Resolution
12.1 Informal Resolution
Before commencing formal proceedings, you agree to first attempt to resolve any dispute with us informally by contacting us at christopher@freedivefinder.com. We will endeavour to resolve the dispute within 30 days.
12.2 Mediation
If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by the Resolution Institute, with the costs of mediation shared equally.
12.3 Court Proceedings
Either party may commence court proceedings at any time if:
- (a) Mediation is unsuccessful or inappropriate
- (b) Urgent injunctive or interlocutory relief is required
- (c) The dispute involves intellectual property rights
13. Changes to These Terms
13.1 We may update these Terms from time to time. We will provide reasonable notice of material changes by:
- (a) Posting the updated Terms within the App
- (b) Updating the "Last Updated" date at the top of this document
- (c) Where practicable, providing in-app notification of significant changes at least 14 days before they take effect
13.2 Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the App and may request account deletion.
13.3 We will not make retrospective material changes to these Terms that adversely affect your rights without your explicit consent.
14. General Provisions
14.1 Governing Law
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.
14.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
14.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
14.4 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
14.5 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
14.6 Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, war, terrorism, government action, power failure, internet disruption, or telecommunications failure.
